A US court ruled against NSO Group in the Pegasus spyware case

Meta Platforms has won an important legal victory: a US court ruled against the Israeli company NSO Group, which used WhatsApp vulnerabilities to distribute the Pegasus spyware.

A federal court in California found that Pegasus was used 43 times through WhatsApp servers in May 2019; NSO Group also failed to comply with a court order restricting access to only Israeli citizens and providing the Pegasus source code. The court found the company guilty of violating WhatsApp’s terms of service, which prohibit malicious use of the platform. In 2019, NSO Group accused WhatsApp of hacking its servers and exploiting a vulnerability in its voice calling functionality (CVE-2019-3568) to install Pegasus on 1,400 devices. She filed a lawsuit against Pegasus, claiming that its software was designed to fight terrorism and crime. At the same time, investigations have shown that Pegasus is being used by authoritarian regimes to spy on journalists, activists and politicians.

NSO Group is an Israeli developer of spyware that is sold to government agencies. Pegasus was used for illegal surveillance and was at the center of scandals; other companies, including Meta (the owner of WhatsApp) and Apple, are fighting NSO Group in court. Apple has introduced a blocking mode and notifications about spyware, which is recognized by experts as an important step in the fight against cyber threats.

The ruling is important for protecting user privacy and sets a precedent for regulating commercial spyware. Further legal proceedings will focus on determining the amount of damages.
