The Italian Data Protection Regulator (GPDP) has announced that foodinho S.A., a subsidiary of DeliveryHero, will be held liable for improper compliance with the Data Protection Act. The company was fined for illegally tracking the geolocation of more than 35,000 drivers, even outside of business hours.

The GPDP found that Foodinho not only sends driver location data to third parties without the drivers’ knowledge, but also uses algorithms to evaluate worker performance without transparency. In addition, the company used biometric driver identification in violation of European privacy laws. It is known that this is not the first fine: in 2021, the company was already fined $2.7 million for opaque performance algorithms.

Foodinho S., a subsidiary of DeliveryHero.r. l., provides GPS food delivery in Italy. Previously, she was repeatedly accused of violating GDPR regulations, and this incident is another warning about the need to comply with privacy laws.
